Título: Conflitos Socioambientais no Cerrado Brasileiro: o Meio Ambiente na Instância Judiciária.

Abstract: Esse trabalho faz uma abordagem inicial dos modelos de desenvolvimento que estão na raiz da crise ambiental e as inquietações nos fóruns internacionais para fazer surgir na agenda política mundial a discussão sobre os limites do meio ambiente e acultura do desenvolvimento sustentável. Fazendo uma retrospectiva jurídico-legislativa, analisa como o ordenamento jurídico nacional incorporou esta matéria. Resgata o conceito de meio ambiente inscrito na Constituição Federal de 1988 e, sob uma percepção eminentemente jurídica, reconhece o conflito ambiental como fruto do choque de interesses em face dos recursos naturais. Em um recorte espacial, o trabalho aborda sucintamente as características dos cerrados brasileiros e principais focos de conflitos ambientais, elegendo, como alternativa para a resolução destes, o espaço oficial de resolução de conflitos, o Poder Judiciário. O foco do trabalho está em levantar e analisar as decisões judiciais sobre litígios ambientais ocorridos na ecorregião do cerrado. Elegeu-se o Tribunal Regional Federal da 1ª Região como o locus da pesquisa, por suas peculiares características, como a de ser uma instância federal de julgamento e ter sob sua jurisdição uma porção do território brasileiro ocupado pelo bioma Cerrado. Como método de pesquisa, preferiu-se a pesquisa jurisprudencial para a averiguação do conteúdo material dos conflitos ambientais, seus protagonistas e o posicionamento do Tribunal no julgamento destes casos. Os resultados demonstraram que ainda são poucos os conflitos ambientais que deságuam no Judiciário e que isso pode ser resultado do alto custo de um processo judicial ou debilidade organizacional dos setores que comumente se envolvem com questões ambientais. Comprovou-se ainda que o ator social que mais tem demandado o Judiciário nas questões ambientais, ao menos no âmbito do tribunal estudado, é o Ministério Público. As decisões proferidas ainda carecem de maior conhecimento das particularidades do setor ambiental, muito embora se reconheça que, nos seus mais recentes julgados, já um esforço empreendido por esse espaço oficial no sentido de incorporar as modernas noções do direito ambiental.
Abstract - This dissertation makes an initial investigation of the development models generating the environmental crisis and the concerns among international groups leading to inclusion of environmental limits and the culture of sustainable development on the global political agenda. A legislative and legal retrospective analyses how the national legal system has dealt with this issue. A study of the environmental concepts set down in the 1988 Federal Constitution, from a strictly legal standpoint, shows that the environmental conflict is the result of opposing interests surrounding natural resources. The work includes a special profile that succinctly describes the characteristics if the Brazilian grasslands (“cerrados”) and the main areas of environmental conflict, appointing the Judiciary as the official and alternative means of resolving these conflicts. This text focuses on researching and analyzing legal decisions relating to environmental litigation brought in the cerrado ecological region. The 1st District Court of the Federal Regional Tribunal was chosen for as the source for research, due to its special characteristics, such as its federal standing and the fact that its jurisdiction includes a portion of the country occupied by the Cerrado biome. The preferred research method was a study of jurisprudence to ascertain the material content of environmental conflicts, their protagonists and the position taken by the Courts when trying these cases. The results show that there are few environmental conflicts that reach the Courts. This may be because of the high costs involved in bringing cases or the lack of organizational capacity within the sectors that are most usually involved in environmental issues. It has also been shown that the most frequent petitioner on environmental issues, at least at state level, is the District Attorney. The rulings that are handed down still lack a greater understanding of environmental issues, although recent rulings clearly show a great deal of effort from the courts to incorporate modern aspects of environmental law.
